1. Acceptance of these Terms

These Terms & Conditions govern access to and use of the Frostlumen Leon website and the restaurant information, enquiry tools and related content made available through it. By using the website, you agree to these Terms. If you do not agree, do not use the website. Separate written terms may apply to reservations, private events, deposits, vouchers, promotions, suppliers or employment.

The website is operated by Frostlumen Leon Pty Ltd , at 17 Marungi Street, South Brisbane, QLD 4101, Australia . References to “Frostlumen Leon”, “we”, “us” and “our” mean that entity.

2. Informational nature of the website

The website provides general information about our restaurant, menus, team, dining experiences and private-event services. Content is provided in good faith but may change without notice. Menu items, ingredients, availability, images, opening arrangements, prices, seating, event options and service details shown online are indicative unless confirmed in writing for a particular reservation or event.

Nothing on this website constitutes professional, medical, dietary, legal, financial or other specialist advice. Guests with allergies or medical requirements must communicate directly with the restaurant and make their own informed decisions.

3. Eligibility and authority

You must have legal capacity to enter any agreement made through or following use of the website. If you submit information for an organisation, group or another person, you confirm that you have authority to do so and that the information is accurate and lawfully provided. Minors should use the website with a parent or guardian where appropriate.

4. Reservations and enquiries

A website enquiry is a request for information and does not itself create a confirmed reservation, event booking or contract. A booking is confirmed only when we issue confirmation through an authorised channel and any required deposit or guarantee has been accepted. Availability may change before confirmation.

You are responsible for checking the date, time, location, party size, contact details, inclusions, price, cancellation terms and special requirements in the confirmation. Notify us promptly of errors or changes. We may set reasonable arrival, seating-duration, minimum-spend, deposit, menu-selection or guest-count requirements for specific bookings.

5. Private events

Private events may require a written proposal or agreement covering the event date, spaces, guest numbers, menu, beverages, suppliers, access times, production requirements, deposits, payment schedule, cancellation, damage, responsible service obligations, security and other operational matters. That event agreement prevails over these website Terms to the extent of any inconsistency.

The organiser is responsible for providing timely, accurate final numbers and requirements and for communicating relevant terms to attendees. Changes requested after agreed deadlines may not be possible and may result in additional charges where permitted by the event agreement and applicable law.

6. Prices, taxes and payment

Prices displayed online may be changed and may exclude optional services, surcharges or event-specific costs unless stated otherwise. The price confirmed for a reservation or event will be communicated through the relevant booking or proposal process. Applicable taxes will be handled as required by Australian law.

Payments must be made using authorised methods. You must not send complete card details through ordinary email or an unencrypted free-text field. A payment is not final until cleared. We may suspend or cancel an unconfirmed service where an agreed deposit or payment is not received by the due date, subject to applicable consumer law and the specific booking terms.

7. Cancellations, changes and no-shows

Cancellation and change conditions depend on the service, notice period, party size, event date and committed costs. The applicable conditions will be provided during booking or in the event agreement. Where a lawful cancellation fee applies, it may reflect reasonable administrative work, reserved capacity, non-recoverable supplier commitments and other loss caused by the cancellation.

We may make reasonable operational changes, including substituting ingredients or adjusting spaces, where necessary because of availability, safety, maintenance, staffing, supplier disruption, force majeure or other circumstances beyond reasonable control. We will aim to provide a suitable alternative or remedy consistent with the agreement and Australian Consumer Law.

8. Dietary needs and allergens

Guests must provide clear, complete and current information about allergies, intolerances, accessibility needs and dietary requirements when booking and again to staff on arrival. We will take reasonable steps to respond to disclosed needs, but kitchens handle multiple ingredients and absolute absence of trace allergens cannot be guaranteed unless expressly confirmed through an appropriate process.

Menu descriptions and photographs are illustrative. Ingredients, garnishes and preparation methods may change. Guests remain responsible for asking questions and deciding whether a dish is suitable. Nothing in these Terms excludes duties that cannot lawfully be excluded.

9. Conduct at the venue and on the website

You must behave lawfully, respectfully and safely. We may refuse entry, service or continued attendance where reasonably necessary to protect guests, staff, property, licences or legal obligations. Prohibited conduct includes harassment, violence, threats, unlawful discrimination, deliberate property damage, dangerous behaviour, unauthorised commercial activity and interference with staff or other guests.

When using the website, you must not attempt unauthorised access; introduce malware; scrape at a rate that disrupts service; bypass security; impersonate another person; submit false, defamatory or unlawful content; or use the website to infringe rights. Reasonable, non-automated browsing and sharing of ordinary page links is permitted.

10. Intellectual property

Unless otherwise stated, the website design, text, branding, graphics, menu descriptions, photographs, illustrations, layout and code are owned by or licensed to Frostlumen Leon and are protected by intellectual-property laws. You may view and print reasonable extracts for personal, non-commercial use related to considering or using our services.

You may not reproduce, republish, sell, license, modify, frame, mirror, distribute, create derivative commercial materials from, or remove rights notices from website content without prior written permission, except where law permits. “Frostlumen Leon” and associated branding may not be used in a manner that suggests endorsement or affiliation without permission.

11. User communications and feedback

When you send an enquiry, review, suggestion, photograph or other material, you confirm that you have the right to provide it and that it is not unlawful, misleading, confidential to another person or infringing. We may use ordinary operational communications to respond and provide the requested service.

If you voluntarily provide general feedback or ideas without a confidentiality agreement, we may use them to improve our services without an obligation to compensate you, while continuing to handle personal information in accordance with the Privacy Policy.

12. Third-party services and links

A third-party service, booking platform, map, payment provider or social platform may be governed by its own terms and privacy policy. A reference to a third party does not necessarily imply endorsement. We are not responsible for content or services outside our control, although statutory rights may apply to services we arrange or supply.

13. Availability and security

We may maintain, update, suspend or withdraw any part of the website. We do not promise uninterrupted or error-free availability. You are responsible for using current, secure software and for maintaining appropriate protection of your device and data. Report suspected website vulnerabilities privately and do not exploit them.

14. Australian Consumer Law

Our goods and services may come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified. Any limitation in these Terms applies only to the maximum extent permitted by law.

15. Disclaimers

To the extent permitted by law, the website and general content are provided on an “as available” basis. We do not warrant that content will always be complete, current, suitable for every purpose or free from minor errors. Visual presentation may differ between devices, and photographs may not exactly represent current dishes or spaces.

We are not responsible for loss caused solely by reliance on outdated general website information where current details were available through the booking confirmation or direct communication, subject always to non-excludable legal rights.

16. Limitation of liability

Where liability may lawfully be limited, our liability for a failure to comply with a guarantee relating to services may be limited, at our option, to supplying the services again or paying the cost of having them supplied again. This limitation does not apply where it would be unfair, unreasonable or prohibited by law, or to liability that cannot be limited.

To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable at the time of contracting. Nothing excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence where exclusion is prohibited, or any other liability that cannot lawfully be excluded.

17. Indemnity for unlawful misuse

To the extent permitted by law, you are responsible for reasonable loss, damage and costs caused by your unlawful use of the website, deliberate breach of these Terms, infringement of another person’s rights, or false information submitted by you. This clause does not require you to indemnify us for our own negligence or conduct to the extent such an indemnity would be unlawful or unfair.

18. Force majeure

Neither party is responsible for delay or failure caused by events beyond reasonable control, such as severe weather, fire, flood, epidemic, government action, utility failure, transport disruption, supplier failure, industrial action, civil disorder or technology outage. The affected party should take reasonable steps to reduce the impact. Deposits, refunds and rescheduling will be handled according to the applicable agreement and mandatory law.

19. Privacy

Personal information is handled as described in our Privacy Policy. By submitting information, you confirm that it is accurate and that you are authorised to provide it. The Privacy Policy is incorporated into these Terms for information-handling matters but does not reduce mandatory privacy rights.

20. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia, and the parties submit to courts with jurisdiction there, subject to any mandatory right to bring a claim elsewhere. Before starting formal proceedings, the parties should attempt in good faith to resolve a dispute through written notice and reasonable discussion, unless urgent relief is required.

21. General provisions

If a provision is invalid or unenforceable, it will be read down where possible and otherwise severed without affecting the remainder. A failure to enforce a right is not a waiver. You may not transfer a confirmed booking or contractual right where the relevant agreement prohibits transfer. We may transfer business rights and obligations as part of a lawful restructure or sale, subject to applicable law.

These Terms, the Privacy Policy, Cookie Policy, booking confirmation and any specific written agreement form the relevant agreement for their respective subject matter. Headings assist navigation and do not control interpretation.

22. Changes and contact

We may update these Terms to reflect changes in services, technology or law. The updated version applies from the date published, but changes will not retrospectively remove accrued rights or alter a confirmed contract without an available legal basis.
